Unless otherwise stated, Radical Labs and/or its licensors own the intellectual property rights for all material on our websites. All intellectual property rights are reserved. You may view and/or print pages from our websites for your own personal use subject to restrictions set in these terms.

You are specifically restricted from:

  • Publishing any website material in any other media without proper attribution
  • Selling, sublicensing and/or otherwise commercializing any website material

RadicalX™ Terms of Service

Introduction

Welcome to RadicalX™, created by Radical Labs. These Terms of Service ("Terms") govern your use of the RadicalX™ application and related services (collectively, the "Services"). By using RadicalX™, you agree to these Terms in full.

RadicalX™ is owned by Radical Labs LLC. This RadicalX™ Terms of Service takes precedence over the company-wide terms for RadicalX™ services.

1. Account Creation and Usage

To use RadicalX™, you must create an account with a valid email address and be at least 13 years old. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us of any unauthorized use or security breach

We reserve the right to suspend or terminate accounts that violate these Terms or engage in inappropriate behavior.

2. User Content and Conduct

When using RadicalX™, you may share information such as your location, kitesurfing activity, and other content ("User Content"). You retain ownership of your User Content, but grant RadicalX™ a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display your User Content for the purpose of operating and improving the Services.

You agree not to:

  • Post content that infringes on others' intellectual property or privacy rights
  • Share false, misleading, or harmful information about kitesurfing conditions
  • Use the Services for illegal activities or to harass others
  • Attempt to access other users' accounts or private information
  • Interfere with the proper functioning of RadicalX™

3. Location Services

RadicalX™ utilizes location data to provide spot check-ins, friend notifications, and spot statistics. By using these features, you:

  • Consent to the collection and processing of your location data
  • Understand that location sharing is optional and can be disabled
  • Acknowledge that location data shared with friends is visible to those users
  • Accept that anonymized location data may contribute to public kitesurfer counts

4. Intellectual Property

The RadicalX™ name, logo, and all related content, features, and functionality are owned by Radical Labs and protected by intellectual property laws. You may not:

  • Use our trademarks or branding without permission
  • Copy, modify, or distribute our app code or content
  • Attempt to reverse engineer the Services
  • Remove any copyright or trademark notices

5. Disclaimers and Safety

Kitesurfing is an inherently dangerous sport. RadicalX™ is provided "as is" and:

  • We make no warranties about the accuracy of spot data or conditions
  • You are solely responsible for your kitesurfing safety and decisions
  • The app should not replace proper training or judgment
  • Local conditions may change rapidly and without warning

Always check local conditions in person, follow safety protocols, and kitesurf with proper training and equipment.

6. Limitation of Liability

To the maximum extent permitted by law, Radical Labs, its officers, employees, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages resulting from your use or inability to use RadicalX™, regardless of whether such damages were foreseeable or we were advised of their possibility.

7. Third-Party Services

RadicalX™ may integrate with third-party services (e.g., weather data providers, social networks). Your use of these services is subject to their respective terms and privacy policies, and we are not responsible for their content or practices.

8. Changes to Terms

We may update these Terms periodically. Continued use of RadicalX™ after such changes constitutes acceptance of the new Terms. We will notify you of significant changes via email or in-app notifications.

9. Governing Law

These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict of law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts located in Wyoming.
